New Tax Proposals Worry Holland Casino

Will the land casino tax have repercussions for Holland Casino's online venture?

Dutch state companies may hold a monopoly on gambling in the Netherlands, but a proposal for a dramatic increase in tax on slot machines is creating waves at Holland Casino...and raises questions about the impact on its online gambling operations due for relaunch with Cryptologic software soon.

Holland Casino is the only company permitted to operate casinos in the Netherlands, and it is concerned for its future if the cabinet pushes through a dramatic increase in the tax on slot machines, reports the publication Expatica. And the gambling company has gone public with its concerns this week.

The Dutch cabinet wants to convert the 16 percent value added tax on the machines into a gaming tax of 40.85 percent and although Parliament still has to express its view on the matter, Holland Casino says that the tax hike could put the continuity of the company in danger and prevent it from turning a profit.

It is not at this stage clear what impact, if any such a tax might have on the online operations of Holland Casino.com, which are currently being extensively re-equipped and upgraded through a contract with online gambling software developer Cryptologic.

Holland Casino currently reports profits of Euro 80 to 90 million a year. A higher tax rate will inevitably result in losses of tens of millions each year, a spokesperson for the gambling company said, pointing out that the current value of the company, around Euro 1.5 billion, could "...evaporate as a result."

Dutch dichotomy as the state continues to protect its monopoly

The Dutch government is cracking down on Internet gambling regardless of EU principles on the free movement of goods and services between European Union member nations, according to the Volkskrant newspaper. Yet state gambling advertising has increased.

Banks and credit card companies are to be held criminally liable if they facilitate Dutch citizens in gambling on foreign internet sites under new justice ministry regulations, the newspaper reported today (Wednesday).

And a list of presumably government banned websites is to be circulated this spring, the report continues.

Internet gambling is in the Netherlands legally confined to the state-owned monopoly holder Holland Casino, which is thought to handle some 400 000 gamblers online. But the justice ministry says at least 30 'foreign firms' are targeting Dutch users.

The Dutch government is already under pressure from the EU compliance arm, Charlie McCreevy's European Commission, to meet EU requirements on permitting access to Dutch players by online gambling companies in member nations. The Commissioner has said that he will not hesitate to take state monopoly protectionist nations before the European Court of Justice.

However, the Dutch government is actively increasing spending on advertising its state-run gambling in contravention of EU rules, according to a leaked letter from internal markets commissioner Charlie McCreevy, reports ANP news service. While the government claims advertising expenditure for the Lotto lottery has fallen, figures from research bureau Nielsen Media show that the number of adverts for the Lotto actually rose 42 percent between 2002 and 2004, McCreevy wrote in the correspondence.

In addition, evidence that the state monopoly on gambling has led to a fall in addiction is questionable and there is no evidence at all to prove it has reduced gambling-related crime, McCreevy added.

The commissioner believes that the Netherlands is pursuing a ‘policy of expansion’ when it comes to the state monopoly for gambling and says there is no reason other European companies should be barred from entering the Dutch gambling market.

State-owned De Lotto and Holland Casino have a monopoly on commercial gambling in the Netherlands and the government has recently given Holland Casino exclusive rights to run internet gambling in the Netherlands, powered by software developer Cryptologic.

A number of foreign operators are currently trying to build land casinos in the Netherlands but have been refused licenses.

A Dutch Justice Ministry spokesman told ANP that the cabinet has replied to McCreevy's claims and that the government maintains its view that the state’s gambling monopoly reduces addiction and crime and is therefore acceptable in terms of EU principles.

Negative vote anticipated on bid to grant online gambling imprimatur to state monopoly

The determination of the European Commission to ensure that EU member states respect the principles of fair, non-discriminatory passage of trade and services between member nations may be at the root of a surprise hold on a vote in the Dutch parliament this week.

The vote, on whether to permit the state gambling monopoly Holland Casino to launch Internet gambling operations, was delayed in the senate on Tuesday at the request of justice minister Ernst Hirsch Ballin, reports Dutch News.nl.

Turnkey provider Cryptologic has been working with Holland Casino to revitalise the Holland Casino online ambitions, but the European Commission has been insistent on EU nations complying with the trade bloc's principles, and has warned ten of the 27 EU nations against state monopolised activity.

Parliamentary sources told news agency ANP that it is likely a majority of Dutch senators would have voted against the plan.
